How do I start the conveyancing process?

The first step is to instruct a solicitor to deal with your sale or purchase on your behalf. If you ask us to act for you, you can contact us as soon as you decide to sell your property or when you start looking for a property to buy.

We are required to carry out identification checks by law, so we can start work on these so that we are able to open a file in readiness for when you have a buyer in place or you have found somewhere to purchase.

If you are selling, we will also let you have the property information forms and fixtures and fittings list to be completed.

Do I need a survey when I buy a house in York?

A house purchase is a major investment and it is always recommended that you have a survey carried out. There are three main types of survey and which one you choose will depend on the property you are buying.

If it is modern and in good repair, you may choose to just have a level 1 condition report, which is the most basic type of survey.

If the property is older or you have any queries over maintenance, you can choose a level 2 or homebuyer survey which is slightly more in-depth.

If you will be buying a property that is more than 50 years old, of an unusual design or you wish to carry out renovations, then a level 3 structural survey may be advisable.

How long does conveyancing in York take?

The length of time taken to complete a conveyancing transaction can vary widely. If there is no chain involved, then it may be possible to complete quite quickly, but where there is a chain then it is necessary to wait until everyone involved is ready to exchange contracts and complete.

This means that everyone will need to have their search results, survey, mortgage offer and satisfactory replies to enquiries. Delays can arise if there is a hold-up on any of these points. Generally, conveyancing is completed in around two or three months. It can be quicker if you are not part of a chain and where the necessary documentation is received quickly.

When can I complete my conveyancing?

When a purchase is arranged, the seller’s solicitor will send contract papers to the buyer’s solicitor. This will include a copy of the legal title and property information. The buyer’s solicitor will apply for searches at this point and then go through all of the available details, raising enquiries on certain points as needed.

If you are obtaining a mortgage, your lender will need to send your mortgage offer to your solicitor. Once this is received and your solicitor has satisfactory search results and replies to the questions they asked, then it will be time to exchange contracts.

A deposit, usually of 10%, is paid to the seller’s solicitor on exchange, so you will need to arrange for this to be sent to your solicitor in advance. If you have a related sale, the deposit from that can generally be used.
