Once your property is on the market, you can think about instructing a solicitor for your sale. If you would like us to represent you, we will let you have the initial forms to fill out at this stage. This will include a property information form with a number of questions for you to answer as well as afixtures and fittings form. You can take your time completing these and put together any information that the buyer may want to see, such as guarantees and planning consents that you may have with your papers.
We will carry out the identity checks that we are required to do by law and open a file in readiness for when you have a buyer.
Once you have accepted an offer for your property, we will make contact with the buyer’s solicitor and send them the initial paperwork. This will include a contract for the sale which we will draft, a copy of the legal title to the property and an official plan and the property information and fixtures and fittings list.
The buyer’s solicitor will apply for searches and also go through all of the documents we have provided. They are likely to come back to us with some questions. Where necessary, we will pass these on to you for your response.
We always work to avoid delays wherever possible. If issues arise at this stage, we have the experience to resolve them efficiently to ensure that your buyer has all they need to exchange contracts as soon as possible.
Once the buyer has their search results and mortgage offer as well as satisfactory replies to their enquiries, they will be ready to exchange contracts. We will discuss proposed dates with you and you will need to check that you can book removals for the suggested completion day.
When you are happy to go ahead, we will speak to the buyer’s solicitor over the phone to exchange contracts. This is the point at which the transaction becomes legally binding. The price will be included in the contract and the completion date added. The buyer will pay a deposit to us which we will hold until completion. This is generally 10% of the purchase price. If you are tying in a property purchase, we will ensure this is ready to exchange on the same day.
After exchange of contracts, we will obtain an up to date mortgage redemption figure. On the day of completion, once you have cleared the property you can leave the keys with the estate agent. We will let them know as soon as we receive the balance of the purchase money from the buyer’s solicitor and they will release the keys to the buyer.
We will send money to your mortgage lender to pay off your mortgage.
The length of time taken to complete a property sale will depend on how soon your buyers are ready to complete. If they have to wait for a mortgage offer or search results, there could be a small delay.
If they are in a chain and someone else is experiencing a delay, then this could also slow matters down. On average, a conveyancing transaction takes around eight to twelve weeks.
We will keep you updated as to the stage your sale has reached and make sure that we are in regular contact with your buyer’s solicitor to check that they have everything they need from us and that they are chasing anyone who needs to respond to them, such as a mortgage lender or search provider.
