You can instruct a solicitor as soon as you decide to start looking for a property to buy or you decide to put your home on the market. If you ask us to deal with your conveyancing, we will carry out the preliminary work straightaway so that once you have had an offer accepted or you find a buyer, we are in a position to start moving your transaction forward immediately.
We will initially verify your identity, open a file and let you have the documents that you will need to fill in. For example, if you are selling, you will need to fill in property information and fixtures and fittings forms. These will be sent to your buyer’s solicitor in the initial package of documents that they will need from us, along with the sale contract.
By putting a solicitor in place early on, you can potentially reduce the time taken to reach exchange of contracts by as much as a couple of weeks. If you are buying a property, it also demonstrates to the seller that you are a serious buyer and are ready to start work.
The length of time taken to complete a sale or purchase can vary quite widely. If you are in a chain, then any hold-ups will affect everyone, so it tends to be a slightly slower process. Potential delays include when someone is waiting for their mortgage offer, where a problem has been revealed on a survey and where documents are awaited from a third party such as the local authority or the managing agent of a block of flats.

If you are buying a property, once you have had an offer accepted, the seller’s solicitor will send us the contract package. This will include details of the legal title to the property, property information forms, a fixtures and fittings list and copies of relevant documents such as planning consents and guarantees.
We will go through the information, apply for searches and send the seller’s solicitor a list of the questions we have.
Your mortgage lender will send us your mortgage offer. Once we have the search results and satisfactory replies to our enquiries, we will report to you on the property and you can sign the contract and the mortgage deed.
We will need a deposit from you to enable us to exchange contracts. This is usually 10% of the purchase price, but if you are tying in a sale, then we can use the deposit from this.
We will discuss completion dates with you and then exchange contracts with the seller’s solicitor. This is the point at which the transaction becomes legally binding and the completion date will be set.
Next, your mortgage advance will be ordered in readiness for completion and we will let you know how much we will need from you in cleared funds.
On the day of completion, we will send the balance of the purchase price to the seller’s solicitor. Once they have received this, they will let us know so that we can tell you. They will also authorise the estate agent to release the keys to you and you will be able to pick them up and move in.
Following completion, we will arrange to pay the Stamp Duty on your purchase and register the mortgage and your ownership with HM Land Registry.
