How does the house purchase process work?

The first step is to speak to a solicitor about representation. If you would like us to act on your behalf, give us a ring and we will let you have the forms that you will need to fill in and explain the start of the process to you.

Once you have an offer on a property accepted, you should give our details to the estate agent and to your mortgage lender. The solicitor will pass our information on to the seller’s solicitor, and they will send us the contract papers.

This is a package of documents including a wide range of information about the property, including a copy of the legal title and plan, property information forms, a fixtures and fittings list filled in by the seller, and other related documents such as guarantees and planning consents.

We will go through this in detail and send the seller’s solicitor a list of questions to be answered. We will also apply for the necessary searches.

Once all the information we require is received and we have your mortgage offer, we will go through everything with you and make sure you are happy. You can sign the contract and mortgage deed at this point. The contract will not be legally binding until the exchange of contracts.

You will need to provide us with cleared funds for the deposit, which is paid to the seller’s solicitors when contracts are exchanged. This is usually ten per cent of the purchase price. If you are tying in a sale, we can use the deposit from this.

The next step is to discuss completion dates with the other parties in the chain. When this has been decided upon and everyone is ready to proceed, we will exchange contracts.

We will then provide you with a statement showing the amount you will need to let us have to complete your purchase, and we will order your mortgage advance.

On the day of completion, we will send the remainder of the purchase money to the seller’s solicitor and contact you once they have received it. You will then be able to arrange to collect the keys to your new home from the estate agent.

Tying in a sale

If you have a sale, we can tie this in at the same time. You can contact us early on when you decide to sell, if you wish, so that we can send you the forms you will need to fill in. This will allow you to complete them at your leisure, as they are relatively lengthy, and you may need to find some paperwork to accompany them, such as guarantees and planning consents.

We will make sure that your buyer’s solicitors have the information they need from us promptly, and that we keep in close contact with them to ensure the transaction is moving forward effectively.
