The legal process for buying a house

Once you decide to move or purchase a property you can call us and we will provide you with the forms that need to be completed. As soon as we have the initial information from you, we can go through the process of opening a file and verifying your identity. This means that we will be ready to start work as soon as we receive the contract papers from your seller’s conveyancer. Getting an early start can reduce the length of time taken to reach readiness for the contract exchange.
When you have an offer accepted on the house you want to buy, you can formally apply for your mortgage. Tell your lender that we will be representing you, and they will arrange to send us your mortgage offer as soon as it is issued.
You can also arrange for a survey to be carried out at this stage. There are different types of surveys available, depending on the age, condition and construction of the property you intend to buy. For example, if you are buying an older home, one that is in poor condition, you intend to make substantial alterations, or the construction is unusual, you will generally be advised to have an in-depth survey carried out so that you have a clear idea of what you are taking on. In any event, you should not rely on your lender’s survey. This is only a basic valuation to confirm that the property covers the amount of their loan.
Once we receive the contract papers from the seller’s solicitor, we can apply for searches. This is usually a local search and drainage enquiries. Depending on where the property is, other searches might be recommended, for example, an environmental search or a mining search.
We will go through all of the paperwork and send a list of questions to the seller’s solicitor to be answered. When we have all of the necessary information, we will report to you on the property. If there is anything out of the ordinary, we will make sure that we go through this with you and explain any legal implications.
When everyone in the chain is ready to proceed, you can let us have your deposit, which is usually 10% of the purchase price. Where you are selling a property at the same time, the deposit on your sale will generally be used.
We will liaise with you and the other parties to agree on the completion day. Contracts will then be exchanged and at that point the contract becomes legally binding.
We will report to your mortgage lender on the legal title to the property and order your mortgage advance in readiness for completion.
On the day of completion, once the seller’s solicitor has received the balance of purchase money from us, we will let you know, and you can contact the estate agent to arrange the collection of the keys.
Following completion, we will arrange for registration of your ownership and the mortgage at HM Land Registry.
