Buying a house or flat with a Bank of Scotland mortgage

If you are buying a house or flat and you will be taking out a Bank of Scotland mortgage, we can represent you in the conveyancing transaction and liaise with the bank to put your mortgage in place.

Contact us as soon as you decide to go ahead, and we will let you have the initial forms. Tell the bank that we will be representing you, and they will send us your mortgage offer once it is approved.

When you have an offer accepted on a property, let us know and pass our details to the estate agent. The agent will let the seller’s solicitor have these so that they can send us the contract package.

We will apply for any searches that are needed and go through the contract papers, checking the legal title and asking any necessary questions of the seller’s solicitor.

Once we have replies, search results and your mortgage offer, we will be ready to report to you on the property and prepare for exchange of contracts. You will need to let us have your deposit and we will discuss potential completion dates with you before the exchange takes place.

On exchange, your deposit is paid to the seller’s solicitor and the completion date becomes legally binding. We will order your mortgage advance and you can confirm your removals in readiness. On the day of completion, we will send the balance of purchase money to the seller’s solicitor and let you know as soon as they have received it. You can then liaise with the estate agent over collection of the keys.

Following completion, we will register your purchase and mortgage with the Land Registry.

Tying in a sale with your purchase

You may well need to tie in a sale with your purchase. You can contact us as soon as your property goes on the market if you want to get a head start, and we will let you have the forms you will need to fill in.

These will include property information and fixtures and fittings forms. By starting work on those now, you will have plenty of time to find any accompanying paperwork that might be needed, such as guarantees or planning consents.

We can also start work on opening a file and verifying your identity, as we are required to do. This means that as soon as you have a buyer in place, we will be ready to send out the contract package to their solicitors. The solicitors will be able to apply for searches and go through the information early on, which can reduce the time taken to reach readiness for exchange of contracts.
